1. General Conditions

1.1 Service Characteristics

Services offered by Eurhosting (Shared Hosting, VPS, Cloud and Dedicated Servers) are identified based on the type chosen when ordering. Each VPS has a bandwidth limit of 1 Gbit/s, unless otherwise agreed. By signing this contract, the Customer accepts the characteristics of the individual packages purchased.

1.2 Additional Services

The Customer may purchase Additional Services (software licenses, backup, firewall, etc.) at or after activation of the main service. The Customer acknowledges that:

• Applications made available by Eurhosting may not be compatible with other applications already installed by the Customer;
• Responsibility for the choice, use and any incompatibility of applications rests exclusively with the Customer;
• Application updates on VPS and Dedicated Servers are the Customer's responsibility;
• Options have the same duration as the main service.

1.3 Backup

A basic backup service is included. Backups are configured by default every 24 hours. Using the backup service reduces but does not eliminate the risk of data loss; the Customer must also perform independent periodic backups. Eurhosting accepts no liability for incomplete or missing backups.

1.4 Right to Modify

Eurhosting reserves the right to modify services and vary offer conditions at any time without notice. Contracts concluded prior to modifications will be honoured under the agreed conditions.

1.5 Limitation of Liability

Eurhosting shall not be liable for service malfunctions caused by telephone or electrical lines, national or global networks, outages, overloads, interruptions, DDoS and cyber attacks, or third-party actions. No compensation may be claimed from Eurhosting for direct or indirect damages caused by use or inability to use purchased services.

1.6 Force Majeure

Neither party is responsible for failures caused by unforeseeable and exceptional events: DDoS attacks, fire, explosion, earthquake, volcanic eruptions, landslides, cyclones, storms, floods, hurricanes, avalanches, war, riots, strikes.

1.7 Service Suspension

Eurhosting reserves the right to suspend the Service, even without notice, in cases of: Customer default; reasonable grounds for unauthorised use; security emergencies; Judicial Authority requests.

2. Contract Duration

2.1 Conclusion and Renewal

The contract is finalised upon payment of the proforma invoice. Duration equals the period selected during ordering and automatically renews for the same duration, unless terminated before the start of the last month of service. If not renewed, the system suspends the service 4 days after expiry and permanently deletes it after 30 days.

3. Acceptable Use and Customer Obligations

The Customer agrees to use the Service in compliance with the law and public order. Expressly prohibited:

• Sending unsolicited commercial messages (spam) or maintaining open SMTP relays;
• Publishing obscene, defamatory, illegal material or material that infringes third-party rights;
• Conducting any type of cyber attack (DoS, DDoS, viruses, trojans, etc.);
• Phishing or any illegal actions aimed at stealing personal data or credentials;
• Publishing gambling or online casino content without required authorisations;
• Violating European personal data protection legislation (GDPR);
• Transferring access credentials to unauthorised third parties.

The Customer must change their access password at least every three months. In case of violation, Eurhosting may suspend or terminate the service without notice, retaining paid amounts as a penalty.

4. Uptime Guarantee

Eurhosting guarantees service availability of at least 99% annually. If this guarantee is not met, a credit equal to one additional month of service will be issued for every 8 hours of downtime exceeding the 99% threshold. The guarantee does not apply to interruptions caused by events beyond Eurhosting's control.

5. Contract Termination

5.1 Termination for Default

The contract terminates by operation of law if the Customer transfers it to third parties without written consent, fails to pay, is subject to insolvency proceedings, or uses services in unauthorised ways.

5.2 Withdrawal by Eurhosting

Eurhosting may withdraw at any time with 7 days' notice via email, returning the pro-rata amount for unused days.

5.3 Withdrawal by Customer and Refunds

The Customer may withdraw at any time via ticket in the client area or by email to info@eurhosting.net. Refund rights:

• Monthly or quarterly services: refund within 7 days of purchase;
• Semi-annual or annual services: refund within 14 days of purchase;
• Software licences and domain registrations are non-refundable.

6. Liability

Eurhosting disclaims liability for delays or interruptions due to force majeure, third-party acts, or customer equipment failures. Eurhosting's total cumulative liability is limited to the amount paid by the Customer in the 3 months preceding the damage.

7. Personal Data Protection

The Customer is the sole Data Controller of personal data hosted on purchased services. Eurhosting acts as Data Processor exclusively within the scope of contractually agreed activities, in compliance with EU Regulation 679/2016 (GDPR).

8. Billing and Payment

All payments are in advance. Accepted methods: credit/debit card, PayPal, bank transfer. Invoices are issued in PDF format. Credits must be used within 12 months, after which they are retained by Eurhosting.

9. Technical Support

Basic technical support is included (up to 5 sessions per year, max 10 minutes each). Email support available 24/7 at info@eurhosting.net. Guaranteed service levels: Connectivity 99%, Power supply 100%.

10. Applicable Law

Applicable law is European law. For consumers, the competent court is that of the Customer's place of residence or domicile.
