Reseller and Web Agency Terms

These Terms supplement the General Terms of Service and the terms of the service used when the Customer resells or manages Eurhosting services for its own customers, through the reseller and web agency hosting plans or through the API. In the event of conflict, these Specific Terms prevail.

E1. Who may be a Reseller

Only Business Customers with a VAT number or equivalent. Eurhosting may request documents about the business and may refuse or close a reseller account without being obliged to give reasons, refunding the unused part of the Period.

E2. Relationship with end customers

The Reseller sells to its own customers in its own name, at prices of its choosing. No contract arises between Eurhosting and the end customers.
The Reseller provides first-line support to its own customers; Eurhosting supports only the Reseller.
The Reseller shall require its end customers to comply with rules at least equivalent to the Acceptable Use rules (section 10 of the General Terms) and is liable to Eurhosting for any breach by them as if it were its own.
The Reseller shall indemnify Eurhosting against claims from its own end customers.

E3. White label

The Reseller may offer the services under its own brand. It may not use the Eurhosting brand in a way that suggests it is Eurhosting or a representative of Eurhosting, nor promise its customers service levels higher than those in these Terms.

E4. Personal data

The Reseller is the data controller (or data processor) of its end customers' data; Eurhosting acts as its data processor or sub-processor in accordance with the DPA. The Reseller provides its customers with the necessary privacy notices and enters into the agreements with them required by the GDPR.

E5. API

API keys are personal to the Reseller, who shall keep them safe and is responsible for all orders and actions carried out with them.
Orders placed through the API are binding and are paid with the saved card. For EU Business Customers the reverse charge applies; without a valid VAT number, orders through the API are not accepted.
Eurhosting may apply rate limits, make incompatible changes to the API with 30 days' notice, and suspend a key that is used abnormally.

E6. Payments and suspensions

The Reseller shall pay Eurhosting even if its own customers do not pay the Reseller. Non-payment for a Service may lead to suspension in accordance with section 7 of the General Terms, also affecting the end customers hosted on that Service.

E7. End of the relationship

When the reseller account is closed, Eurhosting grants the Reseller 7 days to transfer its end customers' websites and data, save where the account is closed for a serious breach or non-payment.
